Problem with finding work

You can go to the labour office and register yourself as an unemployed person or as a job seeker. The labour office assists in job seeking or refers people to courses/internships.

Note! Bring documents proving your professional qualifications with you to the meeting at the office.

I did not receive my remuneration. How do you recover unpaid wages from your employer?

1.) Contact the National Labour Inspectorate.

2.) Independently file a complaint with the National Labour Inspectorate:

  • choose the NLI in your province
  • provide your details and those of your employer (anonymous complaints are not examined). The procedure lasts for approx. 4 months.
  • Note! Not having a written contract signed with the employer makes the process of helping the employee much more difficult!
3.) Turn to the labour court having jurisdiction over the registered seat of the employer.
  • provide your details and those of your employer as well as the reasons for the dispute.
  • the procedure is free of charge.

Fixed term employment contract – when will I get a permanent employment contract?

A fixed term contract cannot be signed more than 3 times and cannot last more than 33 months. These conditions are to be met in aggregate.

In exceptional cases this rule can be waived:

  • replacement of an employee during his/her excused absence from work,
  • performing work of a casual or seasonal nature,
  • performing work throughout the tenure.

If the employer exceeds the time and quantity limits of the fixed-term contract, but in doing so indicates objective reasons for this situation, then the contract will not be transformed into a permanent contract. The employer should then prove that the contract extension serves only to meet the actual periodic demand and is necessary.

  • access your own profile
  • in the Insurances and Payers tab, check whether the person has been registered by the employer and whether contributions are being paid

What is PIT? How to settle it?

PIT means personal income tax. If you work under an employment contract, contract of mandate or contract for specific work, the employer is supposed to file a PIT-11 on its own and then provide it to the employee by the end of February.

The employee, in turn, files a PIT-37 return form based on this by 30 April.

Probationary period at work. Will I get paid for this period?

Probationary period at work may last 3 months at the maximum. It is paid in full.

Note! A probationary contract is to be signed, where the salary to be received by the employee will be stated.

Illegal employment. What are the consequences for an employee?

Working without a contract is illegal. Doing so carries a risk of a fine –
PLN 1,000 and up.

In what situations is it forbidden for an employer to fire me?

  • I am a pregnant woman;
  • I am on holiday;
  • I am on a sick leave;
  • I am at retirement age.
